Liability Waiver & Release

["AP Sauces LLC Accident Waiver and Release of Liability Description: I am voluntarily participating in the purchase of AP Sauces LLC Hot Sauce, which involves consuming one or more extremely hot sauces produced by AP Sauces LLC, including but not limited to sauces containing high levels of capsaicin (e.g., ghost peppers, Carolina Reaper, or extracts exceeding [insert Scoville units, e.g., 1,000,000+ SHU]). I acknowledge and agree as follows: 1. Assumption of Risk. I understand that participating in the Consumption of certain products from AP Sauces LLC involves inherent and significant risks, including but not limited to: intense burning sensations in the mouth, throat, eyes, skin, and digestive system; pain; nausea; vomiting; diarrhea; allergic reactions; choking; temporary or permanent injury to mucous membranes or internal organs; exacerbation of pre-existing medical conditions (e.g., ulcers, heart conditions, asthma); and in extreme cases, serious injury, hospitalization, or death. These risks are inherent to consuming ultra-hot capsaicin-based products and cannot be eliminated. 2. Physical Fitness. I certify that I am in good physical health, have no medical conditions that could be aggravated by extreme heat/spice, and am physically able to participate. I have consulted a physician if necessary. 3. Release of Liability. In consideration of being allowed to participate, I hereby release, waive, discharge, and covenant not to sue AP Sauces LLC, its owners, officers, employees, agents, sponsors, venue operators, and all related parties (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, expense, or injury (including death) that may be sustained by me or my property while participating in the Consumption of AP Sauces products, whether caused by the negligence of the Released Parties or otherwise. 4. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, costs, or expenses (including attorney’s fees) brought by myself, my heirs, or any third party arising from my participation. 5. No Insurance. I understand that the Released Parties do not provide medical or liability insurance for participants, and I am responsible for my own medical expenses and insurance coverage. 6. Rules Compliance. I agree to follow all the items listed above and below clearly provided by AP Sauces LLC. 7. Media Release. I grant AP Sauces LLC permission to photograph, video, or record me during any Challenges/Events and use such media for promotional purposes without compensation. 8. Governing Law. This Agreement shall be governed by the laws of the State of North Carolina. I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY CAREFULLY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT."]
